We managed to lose 3 - 2
 
Not great after being 2 up but 2nd half was mostly Chadderton and thought Atkinson could have cut out the cross for the 2nd and off his line again for the 3rd goal which I thought was struck perfectly.

Good win but how come Bury fielded an ineligible player at start of season? Been fined and points deducted? Who the heck made that mistake? Do you know mate?

It is not as straight forward as it seems, and if we can be got at, it seems fashionable to bash us. It also seems to set a new precedent
it has been said -

How was he ineligible? He was registered in time for the game and cleared to play for us with all paperwork in place and on our squad list the day before the Glossop game, it is in effect a contract dispute between 2 clubs over a player that has nothing to do with the league

I believe the registration was completed correctly. The problem appears to stem from his contract with Congleton. Word is that he believed it had ended but apparently Congleton had offered him an extension which he was required to formally reject, but for whatever reason (he may not even have actually received the offer) he didn’t. I believe that the incomplete paperwork notifying the end of the contract is what has resulted in the player being deemed ineligible to play for another club. The only thing the volunteer did wrong was to take the player’s word that he wasn’t under contract, a situation that the player himself believed to be correct. Congleton themselves have no axe to grind, the issue was made public by a Congleton fan who was annoyed at the player jumping ship.

Also the original game is voided, so we lose the 3 points from the win

The game is to be replayed, so we might get 3 points back

But this seems a new precedent for playing an ineligible player who only came on for the last ten minutes when we were 4 - 1 up

Like a double punishment, but this is still waiting clarification because it is not clear

How come a lawyer checking contracts didn’t ask to see the old contract? That’s a mistake, but still a heavy hit. Also unfair on others as well. Crazy situation. A lawyer is at fault though. Gutted seeing Bury lose points.

As others have stated, we will permanently be deducted 3 points as a punishment for the offence.

In addition and owing to GNE’s protest, the first game of the season will be considered null and void and so will essentially never have happened. We will therefore drop 1 game played, lose 5 goals scored, lose 1 goal conceded and lose the three points from that victory.

The game will be replayed, following which, we have the opportunity to get 3 points and build back our goal difference. Should we win, we will just be the 3 points worse off. It is imperative that we achieve that outcome.

Not only will we replay the game, but the league is essentially using cup rules to justify the replay. This means that both the league and GNE will secure a share of the gate from the replay.

It was claimed by Congleton that Shak was still under contract to them.

Where the confusion lay, is that Shak’s contract expired on May 8th after the last competitive match of the season, but contained a unilateral option to extend meaning that the player cannot turn it down once notice is served.

Congleton claimed that the notice to extend his contract was served by the deadline of May 15th (unilateral extensions must be served within 7 days of the first Saturday in May or 7 days after the last competitive game, whichever the latter). The one stipulation in the contract is that the club extending the contract must bear the burden of proof that the notice has been served.

The evidence indicates that the notice of extension was sent to the wrong address and was never received by the player. Despite this fact, the football authorities believe that the notice of contract extension was suitably served.

There were consequences from the first game too
So since that game:

- The ineligible player has left the club.

- Benito Lowe had a yellow card upgraded to a red and subsequently missed three games

- The Glossop North End player who I think was on the other end of the Lowe incident (Nathan Valentine) has left their club

- The Bury Manager left the club

- The Glossop North End Manager left their club

The whole situation leaves a very sour taste, as both the league and Glossop anticipate a pay day

Horrible situation and definitely sounds like others are taking the piss out of it. Horrible to see happen to Bury.

I do hope that lawyer for bury will be, in future, instructed to check every players last contract before Burys one is offered and signed.
